The purposes for which personal data is processed and the legal basis for the processing:
When do we receive personal data?

VAB receives personal data in the context of the membership in the Association. This already includes the period for initiating a membership.

VAB receives personal data from the legal representatives and employees of the members for the membership administration if employees of the members register for working groups, committees, events or for the member area on the VAB website. In addition, the VAB receives personal data when communicating with the members by electronically, written or by telephone.

Further, VAB receives personal data, e.g. when organising events, fulfilling contracts with customers, suppliers and service providers, receiving business cards, independent contacting or by grands of  given consent.

Furthermore, VAB receives personal data through research in public, legally accessible sources (e.g. commercial register, media, Internet).

Which personal data do we process?

Personal data processed by VAB may include particularily:

Surname, first name(s), title, academic title, gender, professional contact details (postal address, e-mail address, telephone number, fax number, mobile phone number), company function, profession, department.

In the context of membership, especially through personal, telephone or written contacts, initiated by employees of our members themselves or by the member company, further personal data, e.g. information about the contact channel (IP address), date, occasion of the contact, (electronic) copies of correspondence.

How do we process personal data?

Personal data can be processed  paper-based or electronically by VAB. Transfer of personal data to a third country or an international organization is not intended.

For what purpose does the VAB process personal data?

The personal data will be processed to fulfil the purposes of the association’s  statutes. This includes the fostering of the business interests of the members domiciled in the Federal Republic of Germany by representing common interests to legislators, ministries, authorities and other institutions as well as public relations work and by supporting members through general information and advice.

What is the legal basis for the data processing?

VAB processes personal data in accordance with Regulation (EU) 2016/679 (DSGVO), in particular based on

  • Consent, Art. 6 para. 1 lit. a) DSGVO
  • Performance of a contract, Art. 6 para. 1 lit. b) DSGVO
  • Compliance within legal obligation, Art. 6 para. 1 lit. c) DSGVO
  • Purposes of a legitimate interest, Art. 6 para. 1 lit. f) DSGVO

Our legitimate interest is the communication with you on topics relevant to the Association and communicating the corresponding information.

Duration of storage of personal data

VAB processes and stores your personal data as long as this is necessary for the fulfilment of contractual (e.g. association membership) and legal obligations. It should be noted that a membership and, if applicable, a business relationship is intended / layed out for years.

If the data is no longer required for the fulfilment of contractual or legal obligations, they are regularly deleted, unless their further processing is temporarily necessary for the following purposes:

  • Fulfilment of commercial and tax documentation obligations, which may be based, for example, on: German Commercial Code (HGB), Tax Code (AO). The periods for storage and documentation specified there are generally two to ten years.
  • Preservation of evidence within the framework of the statutory statute of limitations. According to §§ 195 ff of the German Civil Code (BGB), these limitation periods can be up to 30 years, whereby the regular limitation period is 3 years.

The following rights are available to you:

  • Right to be forgotten, Art. 17 DSGVO
  • Right to rectification, Art. 16 DSGVO
  • Right to restriction of processing, Art. 18 DSGVO
  • Right to data portability, Art. 20 DSGVO
  • Right to object, Art. 21 DSGVO

If you wish to exercise any of these rights, please contact the data protection officer of  VAB.

It is also possible to lodge a complaint with a supervisory authority.

Your right to object, Art. 21 DSGVO

You have the right to object on grounds relating to your particular situation, at any time to  processing of personal data concerning you which is based on Art. 6 para. 1 lit. e) DSGVO (data processing in the public interest) and Art. 6 para. 1 lit. f) DSGVO (data processing based of a legitimate interest).

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing, which override your interests, rights and freedoms, or the processing serves to assert, exercise or for the establishment, exercise or defence of legal claims.
